We do not currently process Sensitive Personal Information in a manner that would provide you with a right to limit our use of Sensitive Personal Information.

 Annex B: Canada

This Annex applies to individuals located in Canada and supplements the Notice.

B.1 Applicable Laws

Patterson’s processing of Personal Information in Canada is governed by:

  • The Personal Information Protection and Electronic Documents Act (PIPEDA), for private-sector organizations outside Quebec (and federally regulated organizations);
  • Quebec’s Act respecting the protection of personal information in the private sector, as amended by Law 25 (Bill 64);
  • Provincial health information statutes where applicable, including Ontario’s Personal Health Information Protection Act (PHIPA), Manitoba’s Personal Health Information Act (PHIA), and Alberta’s Health Information Act (HIA), to the extent Patterson processes personal health information on behalf of healthcare custodians in those provinces; and
  • Canada’s Anti-Spam Legislation (CASL), for commercial electronic messages.

B.2 Privacy Officer Designation

Law 25 requires designation of “the person in charge of the protection of personal information” (by default, the most senior officer of the organization, who may delegate this function). Patterson designates the following individual/role as its Canadian Privacy Officer:

Data Privacy Officer, Patterson Companies, Inc.

Email: privacy@pattersoncompanies.com (please mark correspondence “Attn: Privacy Officer”)

B.3 Automated Decision-Making

Law 25 requires that individuals be informed when a decision is based exclusively on an automated processing of their personal information, and provides a right to obtain an explanation of the decision and to have it reviewed by a member of Patterson’s personnel. Patterson does not currently make decisions about Canadian individuals based exclusively on automated processing that produce legal or significant effects. If this changes, this Annex will be updated accordingly.

B.5 Cross-Border Transfers (Transfer Outside Quebec)

Before transferring personal information outside Quebec (including to Patterson’s U.S. systems), Law 25 requires that Patterson conduct an assessment confirming the information will receive protection equivalent to that required under Quebec law, taking into account the sensitivity of the information, the purposes of use, the safeguards in place at destination, and the legal framework applicable in the destination jurisdiction (including the possibility of disclosure to a foreign government or authority).

Patterson conducts such “equivalent protection” assessments for transfers of Canadian personal information to its U.S.-based systems and service providers, supported by contractual commitments substantially aligned with the EU Standard Contractual Clauses.

B.6 Privacy Impact Assessments (PIAs)

Law 25 requires a privacy impact assessment for projects involving the acquisition, development, or overhaul of an information system or electronic service delivery project involving personal information, and for transfers of personal information outside Quebec. We review such projects to ensure the transfers are appropriate for the purposes described.

  B.7 Breach Notification

If a confidentiality incident presents a risk of serious injury to an individual, Law 25 and PIPEDA require notification to the applicable privacy regulator (the Commission d’accès à l’information du Québec (CAI) and/or the Office of the Privacy Commissioner of Canada (OPC)) and to affected individuals, and require Patterson to maintain a register of confidentiality incidents. This is addressed through Patterson’s incident response program.

B.8 Your Rights – Canada

In addition to the rights described in Section 12, Canadian individuals have the right to:

  • Request the de-indexing of certain personal information made public online, in specified circumstances (Quebec). Patterson does not publicly post personal information.
  • Request portability of computerized personal information collected from them, in a structured, commonly used technological format (Quebec, effective under Law 25);
  • File a complaint with the OPC (federally/PIPEDA) or the CAI (Quebec).

B.9 Marketing Communications (CASL)

We obtain consent (express or implied, as permitted under CASL) before sending commercial electronic messages, and provide an unsubscribe mechanism in each message. You may withdraw consent at any time.

B.10 Exercising Your Rights – Canada

Contact our Canadian Privacy Officer at privacy@pattersoncompanies.com (Attn: Privacy Officer) or 1-800-328-5536. You may also contact the OPC (priv.gc.ca) or, for Quebec residents, the CAI (cai.gouv.qc.ca).

 Annex C: United Kingdom

This Annex applies to individuals located in the United Kingdom and supplements the General Provisions of this Notice, in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations (PECR).

C.1 Roles: Controller and Processor

For the purposes described in Section 4 and this Annex, Patterson generally acts as a Controller of your Personal Information. Where Patterson provides software or services that process data on behalf of a customer Patterson acts as a Processor on the customer’s behalf, and the customer’s own privacy notice governs that processing, consistent with Section 1.

C.2 Legal Bases for Processing

The table below sets out the legal basis on which Patterson relies for each purpose described in Section 4, for the purposes of Article 6 (and, where applicable, Article 9) of the UK GDPR.

C.3 Sensitive Personal Information

We ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, information related to sex life or sexual orientation, trade union membership, or information pertaining to criminal convictions) on or through the Services, or otherwise to us. If you provide us with any sensitive personal information, you must consent to our processing and use of such sensitive personal information in accordance with this Notice.

C.4 No Automated Decision-Making and Profiling

As part of the Services, we do not engage in automated decision-making and/or profiling which produces legal or similarly significant effects.

C.5 International Transfers

We are a U.S.-based company and many of our service providers, advisors, partners, or other recipients of data are also based in the U.S. This means that, if you use the Services, your Personal Information will necessarily be accessed and processed in the U.S. It may also be provided to recipients in other countries outside of the UK.

It is important to note that the U.S. is not the subject of an “adequacy decision” under the UK GDPR – this means that the U.S. legal regime is not considered by relevant bodies to provide an adequate level of protection for Personal Information, which is equivalent to that provided by relevant UK laws.

Where we share your Personal Information with third parties who are based outside the UK, we try to ensure a similar degree of protection is afforded to it by making sure one of the following mechanisms is implemented: UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses, together with a transfer risk assessment (TRA) as required by the UK Information Commissioner’s Office (ICO).

You may contact us if you want further information on the specific mechanism used by us when transferring your Personal Information out of the UK. You may have the right to receive a copy of the appropriate safeguards under which your Personal Information is transferred by contacting us at privacy@pattersoncompanies.com.

C.6 Your Rights – United Kingdom

If you are located in the United Kingdom, you may ask us to take the following actions in relation to your Personal Information that we hold:

  • Provide you with information about our processing of your Personal Information and give you access to your Personal Information.
  • Update or correct inaccuracies in your Personal Information.
  • Delete your Personal Information where there is no good reason for us continuing to process it – you also have the right to ask us to delete or remove your Personal Information where you have exercised your right to object to processing (see below).
  • Transfer a machine-readable copy of your Personal Information to you or a third party of your choice.
  • Restrict the processing of your Personal Information, for example if you want us to establish its accuracy or the reason for processing it.
  • Object to our processing of your Personal Information where we are relying on Legitimate Interests – you also have the right to object where we are processing your Personal Information for direct marketing purposes.
  • Withdraw Consent. When we use your Personal Information based on your consent, you have the right to withdraw that consent at any time.

You may submit these requests by email to privacy@pattersoncompanies.com or our postal address provided in Section 15. We may request specific information from you to help us confirm your identity and process your request. Whether or not we are required to fulfill any request you make will depend on a number of factors (e.g., why and how we are processing your Personal Information). If we reject any request you may make (whether in whole or in part), we will let you know our grounds for doing so at the time, subject to any legal restrictions.

You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO):

Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, United Kingdom — ico.org.uk

If you are not satisfied with our handling of your Personal Information, you can also submit a complaint to us by email to privacy@pattersoncompanies.com. We will reply to your request as soon as we can.
